Terms and Conditions for the Provision of the Online Appointment Booking Service Available at https://carolina.pl/

These Terms and Conditions define the rules and conditions for using the appointment booking service available on the website https://carolina.pl/ operated by Sport Medica S.A. with its registered office in Warsaw, ul. Pory 78, 02-757 Warsaw, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under KRS number 0000077247, REGON 016291775, NIP 5213095056, share capital: PLN 16,921,000.00 (fully paid up).

Definitions

Hotline – the Sport Medica hotline available at +48 22 35 58 200.

Sport Medica – Sport Medica S.A. with its registered office in Warsaw, ul. Pory 78, 02-757 Warsaw, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under KRS number 0000077247, REGON 016291775, NIP 5213095056, share capital: PLN 16,921,000.00 (fully paid up).

Facility – medical centers operated by Sport Medica S.A.

Terms and Conditions – these Terms and Conditions for the provision of the Service by electronic means.

Appointment Booking – booking appointments for medical consultations, rehabilitation procedures and diagnostic tests via the website https://carolina.pl/.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

Website – https://carolina.pl/

Service – the Appointment Booking service provided by Sport Medica electronically under the terms set out in these Terms and Conditions via the Website.

User – a natural person who uses or intends to use the Service, having full legal capacity and who is at least 18 years old.

General Conditions for Using the Service

The provision of the Service via the Website is carried out using an ICT system enabling the processing and storage of data as well as sending and receiving data via telecommunications networks in accordance with the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws 2019, item 123 as amended).

In order to use the Service, the User selects on the website www.carolina.pl the city where they wish to have the appointment, the specialization or the name of the specialist, or the body part treated by the specialist. After clicking the “search” button, the User receives a list of available appointment dates with specialists. After selecting a date, the User is redirected to the appointment booking page where they provide their personal data: first name, last name, telephone number, e-mail address and PESEL number. The User must also accept the Terms and Conditions. After clicking the “book appointment” button, the User receives an email containing a link. The User must confirm the appointment booking within 10 minutes by clicking the link. If the User does not click the link, the reservation will be cancelled and the link will expire. The User will also receive an SMS reminder to click the link.

Appointment booking through the Website is subject to the following limitations:

  • Sport Medica reserves the right to determine which medical consultations, rehabilitation procedures and diagnostic tests may be booked via the Website.
  • The User may not book more than one appointment for the same type of consultation, rehabilitation procedure or diagnostic test.
  • Appointments may be booked only up to 90 days in advance.
  • Acceptance of these Terms and Conditions by the User is required to complete the Appointment Booking.

The User may make an Appointment Booking provided that a valid email address and telephone number are correctly provided. Immediately after selecting the appointment date, the User will receive an email requesting confirmation of the booking. In order to complete the booking process, the User must click the verification link sent. The verification link remains active for 15 minutes from the moment it is sent.

The User has the right to cancel the appointment up to 24 hours before the scheduled appointment by contacting the Sport Medica Hotline. Failure to cancel the booked appointment may entitle Sport Medica to claim compensation for any damages caused in this way by the User.

Prices indicated on the Website during Appointment Booking do not constitute a commercial offer within the meaning of Article 66 §1 of the Polish Civil Code. Booking an appointment via the Website does not constitute the conclusion of a contract. The price indicated during the booking process is the price resulting from the price list of consultations, rehabilitation procedures and diagnostic tests on the date of booking. The price of consultations, rehabilitation procedures or tests at the Facility will correspond to the price resulting from the price list applicable at the Facility on the date the service is provided.

Technical Requirements

In order to use the Service, the User must have a device with Internet access equipped with a web browser (recommended: Mozilla Firefox version 24.0 or newer, Opera version 10 or newer, Google Chrome version 28.0 or newer, or MS Internet Explorer version 8.0 or newer) that supports cookies and JavaScript. Other browser versions may also be used if they ensure full compatibility with the versions listed above.

For security reasons, it is recommended that the device used by the User has in particular:

  • antivirus software with the latest virus definitions and updates,
  • an effective firewall,
  • all available operating system and browser security updates installed,
  • cookies and JavaScript enabled in the web browser,
  • software capable of reading PDF files.

Processing of Personal Data

The controller of Users’ personal data processed in order to enable the creation of an account and the use of the Website functionalities specified in these Terms and Conditions in accordance with Article 4(7) GDPR is Sport Medica.

In all matters related to the processing of personal data, the User may contact the Data Protection Officer, Ms. Katarzyna Pisarzewska, via email: daneosobowe@luxmed.pl.

Providing personal data, accepting these Terms and Conditions and using the Service are free of charge and voluntary. Providing the data specified in section 4 is necessary to use the Service.

In order to make an Appointment Booking, the User provides their first name, last name, telephone number, email address and PESEL number or date of birth in the case of a child younger than six months.

When using the Service, Sport Medica may also process special categories of personal data relating to health (information about booking an appointment) as well as data related to granted marketing consents, and – where applicable – also the data referred to in point 6 of this section.

Personal data are processed in order to enable the use of the Service (Article 6(1)(a) and (b) GDPR). If the User consents to receiving marketing communications or to the processing of their data for marketing purposes, the data controllers are companies belonging to the LUX MED Group. A full list of companies together with their registration data can be found on the LUX MED website as well as at their registered offices and medical facilities.
Sport Medica may also process personal data in order to pursue claims arising from business activities (Article 6(1)(b) and (f) GDPR – legitimate interest of the controller). As a business entity, Sport Medica also keeps accounting records and fulfills tax obligations, which may involve the processing of personal data.

In order to ensure proper organization of its activities, including IT infrastructure and day-to-day operations, personal data may be transferred to the following categories of recipients:

  • providers of technical and organizational services supporting Sport Medica’s operations (including IT service providers, courier and postal companies),
  • providers of legal and advisory services assisting Sport Medica in pursuing claims (including law firms and debt collection agencies),
  • providers of marketing support services (advertising agencies, SMS and email distribution providers),
  • other medical entities cooperating with Sport Medica to ensure continuity of treatment and access to healthcare services.

Due to the use of external service providers (e.g. IT support), personal data may be transferred outside the European Union. In such cases Sport Medica ensures that appropriate legal safeguards are applied, such as standard contractual clauses approved by the European Commission or adequacy decisions of the European Commission.

Personal data are processed for 5 years and subsequently for the period necessary to pursue possible claims arising from business activities under the Civil Code. If the User is also a patient of Sport Medica and medical documentation has been created, it must be stored for at least 20 years from the date of the last entry. Accounting and tax-related data are processed for 5 years from the end of the calendar year in which the tax obligation arose. Data processed on the basis of marketing consent are processed until the consent is withdrawn. After these periods, the data are deleted or anonymized.

Users have the right to access their data, rectify them, request deletion or restriction of processing, object to processing and transfer their data to another controller. In order to exercise these rights, Users may contact the Data Protection Officer, the Sport Medica hotline, the website or visit any of the Facilities.

Users also have the right to lodge a complaint with the supervisory authority responsible for personal data protection.

Complaints regarding the functioning of the Service will be processed within 14 working days, while complaints concerning other matters will be processed within 30 working days from the date of submission.

Conclusion and Termination of the Electronic Service Agreement

With regard to the provision of the Service, these Terms and Conditions constitute regulations within the meaning of Article 8 of the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws 2020, item 344).

The agreement for the provision of the Service is concluded between Sport Medica and the User at the moment the User accepts these Terms and Conditions and is automatically terminated upon completion of the Appointment Booking process.

Final Provisions

The User is obliged to use the Service in accordance with the laws applicable in the Republic of Poland, these Terms and Conditions and to refrain from providing unlawful content.

Sport Medica shall not be liable for the consequences of services provided electronically if the User causes the service to be carried out in a manner inconsistent with applicable law or these Terms and Conditions.

Sport Medica is entitled to block access to the Service for security reasons.

Access to the Service may be blocked on the basis of system data analysis in the event of:

a) using User devices for automated logins with high frequency or sending a large number of requests to the server
b) using Sport Medica systems in a manner inconsistent with applicable law
c) performing actions that may threaten the security of Sport Medica systems and the data processed therein

In matters not regulated by these Terms and Conditions, the provisions of the Polish Civil Code and other generally applicable laws of the Republic of Poland shall apply.

If the User is a consumer within the meaning of the Civil Code and wishes to use an out-of-court dispute resolution mechanism, they may submit a complaint through the EU ODR platform available at:

Court disputes shall be resolved by the competent common court determined in accordance with the provisions of the Code of Civil Procedure.

Users may access these Terms and Conditions free of charge at any time via a link available on the website www.carolina.pl and may print them.

All exclusive rights to the content available on the Website, including within the Service, in particular copyrights to photographs, trademarks belonging to Sport Medica, graphic elements, software and database rights, are legally protected and belong to Sport Medica or entities cooperating with Sport Medica.

Copying or otherwise using any elements of the Website without the consent of Sport Medica is prohibited.
